BRANCH OPINION


DUCT TYPE SMOKE DETECTORS REQUIRED FOR A HEATING SYSTEM AS A RESULT OF CREATING A SELF-CONTAINED APARTMENT IN AN EXISTING HOUSE

Where the building is more than 5 years old, Part 11 of the building code would apply to the change of use with construction. Part 11 also provides the specific requirements regarding which items are to be evaluated.

Sentence 11.3.4.1.(7) lists the items to be evaluated above and beyond the scope of the work proposed. Section 9.33. which deals with Heating and Air-conditioning is not on of the items listed.

Therefore, it is the opinion of the Housing and Development Branch that unless the existing heating system is coupled with the ventilation system required in Section 9.32. or there are alterations to the existing heating system, there is no requirement in Part 11 for duct type smoke detectors in the heating system.
