CLARIFICATION OF DWELLING UNIT

BRANCH OPINION

RE: CLARIFICATION OF DWELLING UNIT

The following is the Branch opinion dealing with a proposal from Creative Accommodations Supporting Adults (CASA) as to whether its proposed concept should be considered as a dwelling unit or a group home for the purposes of the Ontario Building Code.

According to the information provided us, a 4 bedroom bungalow would:

be used by a maximum of 4 individuals who, except for their limitations in performing domestic tasks, would otherwise be considered independent,
the tenants would be capable of residing in an unsupervised environment, and
these individuals would be capable of responding to emergency situations.

Based on the above conditions, our opinion is that the use of the structure would most accurately be described as a dwelling unit subject to the following conditions:

the individuals would not require constant medical or security supervision,
the residents would have access to all areas of the structure, and
should an individual's condition evolve to a point where medical or security supervision is required, that individual would be relocated to a more appropriate and protected facility.
