When determining an occupant load for a multiple use occupancy, for example; a billiard hall with a portion being used as a restaurant and another part being used as a stand-up bar serving alcoholic beverages, would the tenancy occupant load be based on the most restrictive area per person namely 0.6 m2/person?
Answer.
No, it is the Branch opinion that the total occupant load for a tenancy be calculated on the bases of the area per person applied to that particular use of the area. In the example above, the total occupant load would be based on 9.30 m2/person for the portion being used for billiards, plus the occupant load for the restaurant portion based on 1.10 m2/person (assuming the restaurant has seats and tables and is serving alcoholic beverages) and in addition the occupant load for the stand-up bar portion based on 0.6 m2/person.
